Werklab – Terms of Service

This Terms of Service Agreement (“Terms”) is a legal agreement between you (“you” or “Member”) and Werklab Inc. (“Werklab,” “we,” “us”). These Terms apply to your use of Werklab’s workspace, facilities, amenities, services, programs, events, website, and member portal (collectively, the “Services”).
By accessing Werklab, creating an account, booking, purchasing, or clicking “I Agree” (or similar), you agree to these Terms and acknowledge you are waiving certain legal rights, to the extent permitted by law.
1) Eligibility
You must be at least 18 years old to use the Services. If you are under the age of majority in British Columbia and require a parent/guardian to contract, you may only use the Services with a parent/guardian’s consent and supervision and any required forms completed.
2) Accounts & Member Portal
You may be required to create and maintain an account. You agree to provide accurate information and keep it up to date. You are responsible for safeguarding your login credentials and all activity under your account. Notify Werklab immediately of suspected unauthorized access.
3) Membership, Access & No Tenancy
Membership grants a revocable license to use Werklab in accordance with your membership type and posted policies. Membership does not create a lease, tenancy, or real property interest. Werklab retains possession and control of the premises at all times.
Access cards/fobs are non-transferable and may not be shared. Lost cards/fobs may be replaced for a fee.
4) Fees, Billing & Payment Processing
Fees are billed monthly in advance and due on the 1st of each month unless otherwise stated.
A valid credit card must be kept on file at all times.
Initial charges may be prorated and may include initiation/access fees.
Werklab may change fees or plans with 30 days’ written notice.
Late/unpaid accounts may be suspended or terminated; late charges, interest, NSF/decline fees, and collection costs may apply as permitted by law.
No refunds: once processed, payments are final and non-refundable, except where required by law.
Werklab may use third-party payment processors; processing is subject to their terms and privacy policies. Werklab is not responsible for processor errors or delays.
5) Cancellations & Changes
A minimum 30 days’ written notice is required for cancellations or plan changes. If notice is received late, changes take effect in the following billing cycle. Fixed-term memberships may require payment of the remaining term if ended early. Membership holds may be available for eligible plans subject to Werklab policy.
6) Code of Conduct, Guests & Community Standards
You agree to follow the Werklab Code of Conduct and all posted rules. You are responsible for your guests, employees, and contractors at all times. Werklab may refuse access to or remove any person for safety, disruption, non-compliance, or policy breaches.
Harassment, discrimination, threats, violence, hate speech, illegal substances, or unsafe conduct are not tolerated and may result in immediate termination.
7) Assumption of Risk (Wellness, Events, Premises Use)
Werklab may offer or host wellness programming, events, workshops, and community activities. Participation is voluntary. You acknowledge that use of the premises and participation in any activity may involve risks including injury, illness, property loss, or other harm. You assume all risks associated with your participation and use of the Services and agree to consult a medical professional before participating in physical activities.
You agree not to participate while under the influence of drugs or alcohol.
8) Release of Liability & Indemnity (To the Extent Permitted by Law)
To the fullest extent permitted by law, you release Werklab and its directors, officers, employees, contractors, agents, and affiliates from claims arising from or related to your use of the Services, including participation in activities and presence on the premises, except to the extent caused by Werklab’s gross negligence or wilful misconduct (where such limitation is not permitted by law).
You agree to indemnify and hold harmless Werklab from third-party claims arising out of your conduct, your guests’ conduct, or your breach of these Terms.
Werklab assumes no responsibility for lost, stolen, or damaged personal property.
9) Damage to Property
You are financially responsible for damage caused by you or your guests, including repair, replacement, cleaning, or service costs.
10) Service Changes & Availability
Services (including hours, amenities, meeting rooms, internet, events, and access) are provided “as available” and may change, be interrupted, rescheduled, or discontinued. Werklab does not guarantee uninterrupted access or internet security.
11) Promotions, Pricing Mistakes & Corrections
Werklab may offer promotions or discount codes at its sole discretion and may modify or end them at any time. Werklab may correct pricing errors or inaccuracies and may cancel or refuse orders/bookings affected by errors.
12) Intellectual Property
Werklab’s name, logo, website content, photos, and materials are owned by Werklab or its licensors and may not be copied, reproduced, republished, or used commercially without written permission.
13) Electronic Communications
You consent to receive electronic communications from Werklab (including email) about your membership, billing, policies, and Services. Electronic notices satisfy legal “in writing” requirements.
14) Privacy
Your use of the Services is subject to Werklab’s Privacy Policy. By using the Services, you consent to the collection, use, and disclosure of personal information as described in the Privacy Policy.
15) Governing Law
These Terms are governed by the laws of British Columbia and applicable federal laws of Canada. You agree to the jurisdiction of the courts of British Columbia, except where consumer protection laws require otherwise.
16) Changes to These Terms
Werklab may update these Terms from time to time. Continued use of the Services after updates constitutes acceptance of the revised Terms.
